Due to official industrial action by the CPSU and the PSEU, The Public Telephone service of the Private Residential Tenancies Board will not be open on the afternoon of Monday the 15th of March. We would like to apologise for any inconvenience this causes. We will return to regular hours on Tuesday the 16th of March 2010 where we are open to the public between 10am and 1pm and between 2pm and 4pm Monday to Friday.

Michael Finneran T.D., Minister for Housing and Local Services, announced the coming into effect of the final elements of the package of measures approved by the Government last year to improve standards in rental accommodation. “With the commencement of provisions in the Housing (Miscellaneous Provisions) Act 2009, the Government has now fully delivered on its commitment in Towards 2016, the programme for Government, to update the minimum standards regulations for the private rented sector".

Notice for Landlords

Important Changes to Tenancy Registration Requirements

 Amendments to the Residential Tenancies Act 2004

    Part 7 of the Housing (Miscellaneous Provisions) Act 2009 (which came into law on the 15th July 2009) contained a number of amendments to the Residential Tenancies Act 2004. 

    In relation to the amendment to Section 135 (5) of the Act and its implementation by the PRTB, a landlord has 1 month from the tenancy commencement date to apply to the PRTB to register a tenancy. If the form submitted is incomplete it will be returned by the PRTB and the late fee will apply unless it is resubmitted within the month.  However, in view of the current backlogs in registrations the Board have decided to adopt a practical approach in relation to the change in legislation as it relates to the late fee until such time as the online system is up and running in early 2010.  

    Section 135 (2) of the Residential Tenancies Act has been deleted. This removes the requirement for landlord and tenant signatures on the tenancy registration form and was introduced to facilitate online registration due to be introduced in 2010. However, please do bear in mind that this only applies to applications which were received after the commencement of the legislation, ie the 15th of July 2009.

Section 109 Rules

   These rules are made by the Private Residential Tenancies Board (the Board) under section 109 of the Residential Tenancies Act 2004 (the Act) and are subject to the provisions of the Act.  They may be amended at any time by the Board with the consent of the Minister and they supersede any previous such rules pursuant to Section 109 as adopted by the Board.  The Board will process disputes referred to it in accordance with the provisions contained in Part 6 of the Act. For the purposes of the Rules below, PRTB management refers to the PRTB Director or an Assistant Director.

Third Party Applications for PRTB Dispute Resolution

   Under Section 15(1) of the Residential Tenancies 2004, a landlord of a rental dwelling owes to each person, who could be potentially affected (e.g. by anti-social behaviour), a duty to enforce the obligations of the tenant under the tenancy. In cases where a landlord fails to enforce a tenant’s obligation under Section 16 of the Act, a directly and adversely affected individual may take a case against the landlord through the Private Residential Tenancies Board (PRTB). The procedure to be followed is set out in the attached information note.

Tenancy Registration Backlogs

   Please note that due to considerable backlogs it is currently taking up to 16 weeks from the date of receipt of registration forms to process a tenancy registration. When the tenancy is registered the landlord and the tenant will receive a letter in the post confirming that the tenancy has been registered. The PRTB wishes to apologise for this delay.

Minister Finneran launches the PRTB Corporate 2009-2011

 Mr.  Michael Finneran T.D., Minister of State for Housing, Urban Renewal and Developing Areas, today (16 Dec. 2008) launched the Corporate Plan 2009-2011 of the Private Residential Tenancies Board (PRTB).

 The Corporate Plan is both forward-looking and action-orientated while framed within the legislative provisions of the Residential Tenancies Act 2004. The Plan aims to strengthen the organisation’s capacity to deliver on its mission and mandate and to meet the needs of its customer base from a quality-service and value-for-money perspective. Its success will ultimately be measured in terms of the ambitious targets that have been set out in the Plan.  

The Minister commented that the Corporate Plan provides a very clear self-analysis of the PRTB and provides a useful road map for the future. “It is essential that the Board, recognising the pressures on its services, has a clear perspective on how it aims to deliver its services in as efficient a manner as possible. By identifying clear areas of activity, and related targets and performance measurement indicators, the PRTB is setting real benchmarks against which its progress can be measured “, he said.

 The Minister also commented that, “Far too often the good work being done by the PRTB goes under-reported and the fact that that 99% of landlord-tenant relationships work well, is ignored. Today, however, I want to publicly recognise

the tremendous achievements by the staff of the PRTB over the last year or so. Recognising the need to continually strive for improvement, real imagination is being shown by the PRTB in identifying ways to work both smarter and faster.

  • In the interest of security and safety the PRTB will no longer accept cash in payment of fees for Registration of Tenancies or Dispute Resolution.   

    Registration Fees and Dispute Fees can be paid using any of the following methods:

     

  •    Bank Draft made payable to "PRTB"
       Money Order made payable to "PRTB"
       Cheque made payable to "PRTB"
       Laser Debit Card
       Credit Card (except American Express)

    Cash received through the post or hand delivered to the PRTB offices will be returned to the sender the same day together with any accompanying forms.  It is therefore in the applicant’s interest to ensure that they use one of the payment methods listed above.
